Terms of Service

Welcome to Bvcket ("we," "us," "our"). By accessing or using our website, application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account registration

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration;
  • Maintain and promptly update your account information;
  • Keep your login credentials confidential and not share them with any third party;
  • Accept responsibility for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account.

3. Subscriptions and payments

3.1 Plans

Access to certain features of the Service may require a paid subscription or other fees. Plans, pricing, and features are described on our website and within the application when available.

3.2 Billing

If you purchase a subscription, it may be billed on a recurring basis (for example, monthly or annually) depending on the plan you select. By subscribing, you authorize us and our third-party payment processors to charge the applicable fees to your chosen payment method.

3.3 Free trials

We may offer free trials at our discretion. When a trial ends, your subscription may automatically convert to a paid subscription unless you cancel before the trial period ends, as disclosed at signup.

3.4 Cancellation and refunds

You may cancel a paid subscription according to the cancellation process shown in your account or the applicable app store or payment platform. Cancellation typically takes effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws or regulations;
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or related systems or networks;
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Service except where prohibited by law;
  • Copy, modify, distribute, sell, or lease any part of the Service or its content except as expressly permitted;
  • Use automated means (bots, scrapers, etc.) to access or collect data from the Service without our prior written consent;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Transmit viruses, malware, or other harmful code;
  • Harass, abuse, threaten, or defame any person;
  • Use the Service to engage in illegal gambling or wagering where prohibited.

5. Intellectual property

All content, features, and functionality of the Service—including text, graphics, logos, data compilations, software, and analytics—are owned by Bvcket or its licensors and are protected by copyright, trademark, and other laws. You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes, unless we agree otherwise in writing.

6. User content

If you submit content through the Service ("User Content"), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that content as needed to operate and improve the Service. You represent that you have the rights to grant this license and that your User Content does not violate third-party rights.

7. Data and privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described there.

8. No financial, investment, or wagering advice

NOTHING PROVIDED THROUGH THE SERVICE CONSTITUTES FINANCIAL, INVESTMENT, LEGAL, TAX, OR PROFESSIONAL ADVICE OF ANY KIND. All content made available on or through the Service—including but not limited to analytics, models, projections, probabilities, ratings, edges, picks, alerts, articles, charts, and any other outputs (collectively, the "Content")—is provided strictly for informational, educational, and entertainment purposes.

The Content is not a recommendation, solicitation, endorsement, or offer to place any wager, bet, trade, or financial transaction, and is not intended to be relied upon in making any betting, gambling, investment, or other financial decision. We are not a licensed broker, dealer, investment adviser, financial planner, sportsbook, or bookmaker, and no fiduciary or advisory relationship is created by your use of the Service.

You are solely responsible for any decisions you make and any wagers, trades, or transactions you place. Past performance, historical results, simulated results, and modeled probabilities are not indicative of future outcomes. You should consult a qualified professional before making any financial decision and should never wager more than you can afford to lose.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

INFORMATION PROVIDED THROUGH THE SERVICE—INCLUDING SPORTS ANALYTICS, DATA, AND PROJECTIONS—IS FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED ON AS THE SOLE BASIS FOR ANY DECISION, INCLUDING WAGERING OR FINANCIAL DECISIONS. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY INFORMATION.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BVCKET AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY DOLLARS ($50.00), EXCEPT WHERE PROHIBITED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bvcket and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of third-party rights.

12. Third-party services

The Service may integrate with or link to third-party services. We are not responsible for the content, privacy practices, or availability of third parties. Your use of third-party services is at your own risk and subject to their terms.

13. Changes to the Service and Terms

We may modify, suspend, or discontinue the Service at any time. We may update these Terms; material changes will be posted on the Service with an updated "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access at any time, with or without cause or notice. Upon termination, your right to use the Service ceases. Provisions that by nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. Disputes shall be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to personal jurisdiction there.

16. Severability

If any provision is held unenforceable, that provision will be limited or eliminated to the minimum extent necessary so the remainder of these Terms remains in effect.

17. Entire agreement

These Terms, together with our Privacy Policy and other agreements expressly incorporated by reference, constitute the entire agreement between you and Bvcket regarding the Service.
